LEARN HOW TO BE A GOOD BOARD MEMBER


There are many reasons why homeowners serve on their board of directors - personal agendas, ego, civic duties, or peer pressure. No matter the reason, serving on the board is not something to be taken lightly.

Board members need to pay attention and be willing to make hard decisions. When you agreed to serve on the board of directors, you accepted certain elements of responsibilities in addition to a commitment of time and accountability to your association. Board members act on behalf of the homeowners so you will want to be the best board member possible because while a smoothly functioning board can be nirvana, a dysfunctional, nit-picking, and micro-managing board can be an association's worst nightmare. YEAR END FINANCIALS


The financial statement in most Associations are available for the year ending December 31, 2010, as provided by the Association’s CPA.  In accordance with Florida Statue 720.303(7) and Florida Statue 718.111(13) the Association is not required to mail the yearend financial report, provided that the owners are notified that a copy of the financial report is available to them upon receipt of a written request.  If you would like to receive a copy please submit a written request to: Custom Property Management, Inc., 2328 South Congress Avenue, Suite 2A, West Palm Beach, FL 33406 and one will be supplied.

RECORDS: TELEPHONE DIRECTORIES AND UNINTENDED CONSEQUENCES

The version amending the Condominium Act, §718.111(12)(c)5, provides that the following shall not be accessible to unit owners:
Social Security numbers, driver’s license numbers, credit card numbers, email addresses, telephone numbers, emergency contact information, any addresses of a unit owner other than as provided to fulfill the association’s notice requirements, and other personal identifying information of any person, excluding the person’s name, unit designation, mailing address and property address.
The Homeowners’ Association Act amendment to §720.303(5)(c)5 contains the exact same language, except utilizes the term “electronic mailing addresses” for “email addresses.” While the new law achieved its purpose of allowing Florida associations to protect the privacy of owners, reducing undesired telephone calls, there was an unanticipated result. It appears that the law will prohibit associations from publishing owner telephone directories. Complicating matters is the Condominium Act’s anti-waiver provision, §718.303(2) Fla, Stat.
Florida community associations that desire to continue publishing telephone directories should consider asking owners to provide a request for publication. To facilitate matters, request might be considered to be incorporated into application forms and annual meeting package requests. Contact your Association attorney as to considerations and procedures.
